The data-centre buildout runs into local vetoes

Virginia’s Loudoun County board voted to pause new data centre applications, introducing a 12-month moratorium in what the trade press calls the sector’s hotspot¹. The Scottish Parliament passed a pause on new data centres in Scotland on Wednesday evening, brought as a motion by the Scottish Greens². That measure is a watered-down version of the full moratorium campaigners had been calling for over several months².

In North Carolina, Republican regulators rejected a gas plant intended to serve an Amazon data centre, citing Trump’s Ratepayer Protection Pledge⁴. Not every jurisdiction is tightening: Brazil’s President Lula signed the ReData data centre bill into law after the Senate passed it in September³.

Why it matters to investors

The binding constraint on AI infrastructure is shifting from chips and capital to land, permits and power. Loudoun’s pause is a supply freeze in the densest cluster of its kind¹, and the North Carolina decision ties approval to household electricity bills rather than to the developer’s own economics⁴. Both are decisions taken by elected or politically accountable bodies rather than by markets, and neither turns on the cost of capital or the availability of accelerators^1,4.

The politics are broadening beyond zoning fights. In Florida, David Jolly said a complete ban on data centres should be on the table, arguing that it does not hurt the national security strategy to say no to data centers in Florida⁵. Brazil’s route is the opposite one, a national statute rather than a local veto, which suggests the siting question is being settled at different levels of government in different countries^1,3.

What to watch

Operational risk is becoming a public argument too. A fire broke out in one unfinished building of a data centre under construction in Somerset, New York, in early June, and the local fire department found it a difficult one, with heavy smoke in a windowless lab and a long burn before the call came in⁶. Incidents like that feed the permitting debate directly, because the bodies granting approvals are the same ones that fund the emergency services responding to them^1,6.

Three markers matter from here. Whether Loudoun’s pause is extended beyond its 12-month term¹; whether the Scottish motion hardens into the fuller moratorium its sponsors wanted²; and whether other utility regulators follow North Carolina in weighing ratepayer costs against data-centre load^4,5.
